Terms of Service

1. Acceptance

Unstable (the “interface”) is a web front end to a set of public, non-custodial smart contracts. By accessing or using the interface you agree to these Terms and to the Risk Disclosure. If you do not agree, do not use the interface.

2. What Unstable is

Unstable is a non-custodial software tool that connects buyers and sellers of USDC. Prices and premiums are set entirely by makers — we do not set, influence, or recommend them. We take no custody of funds, are not a party to any trade, and provide no brokerage, exchange, or investment service.

Unstable is served only from its official domains — unstabletrade.com and unstabletrd.com (including their www. subdomains). Both are operated by the same team and serve the same interface. Any other domain presenting this interface is an unauthorized copy: do not connect a wallet or sign anything there.

Unstable is not a bank, broker, dealer, exchange, money-services business, or custodian. It does not hold, manage, or control your funds, does not match or execute trades on your behalf, and is not a counterparty to any trade. Every trade happens directly between independent makers and takers through public smart contracts that you interact with from your own wallet.

3. Eligibility

You must be of legal age in your jurisdiction and legally permitted to use services of this kind. You may not use the interface if you are located in, or a resident of, any jurisdiction where doing so is prohibited, or if you are subject to sanctions. Ensuring your use is lawful where you are is your responsibility.

4. Your wallet, your keys

You interact with the interface using your own self-custody wallet. You are solely responsible for your wallet, your private keys, the security of your device, and every transaction you sign. Transactions on public blockchains are final and cannot be reversed, cancelled, or refunded by us.

5. How trades work

Makers lock USDC in a liquidity escrow contract and set their own premium, from 0% up to 10,000%. Takers choose an offer and escrow their payment — the maker’s proceeds plus a service fee — on the other chain. An automated settlement agent (the “desk”) moves the escrowed funds only along the committed path: the maker receives their proceeds, the fee wallet receives the fee, and you receive your USDC. The desk cannot redirect funds to itself. We do not set, endorse, or recommend any premium — prices are chosen entirely by makers, and you decide whether to accept them.

6. Fees

The interface facilitates a flat 3% service fee, paid by the taker on top of the maker’s proceeds and shown in the quote before you sign. Fees are earned on settlement and are non-refundable. Blockchain network (gas) fees are separate and paid by you to the network.

7. No custody; refunds are on-chain

Because we never hold your funds, we cannot issue or deny refunds. If a trade does not settle, the escrow contract returns your payment to you: the desk fail-closes by refunding, and if the desk is unavailable you can reclaim your payment yourself after the on-chain timeout. 8. Third-party services

The interface relies on third-party services we do not control, including your wallet provider, wallet-connection tooling (Privy, WalletConnect), blockchain RPC providers, and hosting infrastructure. Their availability and conduct are outside our control, and their own terms apply to your use of them.

9. No warranties

The interface is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the interface will be uninterrupted, error-free, or secure, that the smart contracts are free of vulnerabilities, or that any trade will settle within a given time.

10. Limitation of liability

To the maximum extent permitted by law, Unstable and its contributors are not liable for any indirect, incidental, special, or consequential damages, or for any loss of funds, profits, or data, arising from your use of the interface, the smart contracts, or any third-party service.

11. Risk

Using Unstable involves significant risk, including the total loss of funds. You accept the risks described in the Risk Disclosure as a condition of using the interface.

12. Changes

We may update these Terms from time to time. Continued use of the interface after an update means you accept the revised Terms.
